Excision
Table of Contents
Excision means a portion of land that the government released to the Indigenous settlers or the original inhabitants of the community. When they say the land is an excised land, it means that the land is legally free from government acquisition.
Excision is not a Title document, and never let anyone mislead you that excision is a Title document. Excision can only be considered as a title until a C of O is obtained on it, otherwise, it is to be kept in view upon completion of the C of O.
Land can be excised but not gazetted, for a land to be officially excised, it needs to be gazetted by the government.
Gazette
A gazette is an official publication/document revealing that certain land at a community or location has been excised. In other words, GAZETTE is an Official record book where all special government details are spelt out and recorded.
A GAZETTE will show you the communities or villages that have been granted excision and the number of acres or hectares of land that the government has given to them.
It is within those excised acres or hectares that the traditional family is entitled to sell its lands to the public and not anything outside those hectares of land given or excised to them.
If they decide to sell anything outside the excised land, then that land is under acquisition by the government and it is a very bad land to buy.
Final Remarks
If you buy land with Excision and it is not Gazetted, you might have challenges processing a title document for your land, because the Excision has to be pronounced in the official government record, which is the Gazette.
So when a real estate marketer/developer tells you that the Title on the land to be sold is Excision, please walk away or do your proper due diligence, “Excision is not a Title Document”
Make sure you conduct a background check using a reputable real estate consultant/development expert before you conclude any transaction as per land with the ” Excision “ clause in Nigeria.
